Terms of service
The terms that govern your use of HansaPay's payment processing, settlement and payout services, and of hansapay.io.

These terms of service ("Terms") form an agreement between you and HansaPay, Inc. ("HansaPay", "we", "us"). They govern your access to and use of our payment services, the HansaPay dashboard, our APIs, and hansapay.io (together, the "Services"). By creating an account or using the Services, you agree to these Terms.
Eligibility and your account
To use the Services you must be a business or individual acting for business purposes, be legally able to enter into contracts, and be located in a country we support. You must provide accurate, complete and current information when you open an account and keep it up to date.
We are required by law to verify the identity of the businesses we serve and their owners. We may request additional information at any time and may decline, limit or close accounts at our discretion, consistent with applicable law.
You are responsible for all activity under your account and for keeping your credentials and API keys secure.
The services
HansaPay enables you to accept card and wallet payments from your customers, settles cleared funds to your HansaPay balance, and allows you to withdraw that balance to a bank account you control. Features, payment methods and currencies vary by country and may change over time.
Fees
You agree to pay the fees set out in your agreement with us and shown in your dashboard. Fees are deducted from the funds we settle to you. We may change our fees with at least 30 days' notice.
You are responsible for any taxes that apply to your transactions and to your use of the Services, other than taxes on our net income.
Settlement, reserves and payouts
We settle cleared funds to your balance net of fees, refunds and chargebacks, on the schedule shown in your dashboard. The baseline schedule is T+5, five days after the transaction date, and the schedule that applies to your account depends on your industry and risk profile. Settlement may be delayed where required by law, by our banking partners, or for risk reasons.
We may place a reserve on your balance, or delay settlement, if we reasonably believe there is an elevated risk of refunds, chargebacks, fraud or other liability. We will tell you the reason and the expected duration where we are allowed to.
HansaPay is not a bank. Balances held in your HansaPay account are not deposits and do not earn interest.
Refunds, disputes and chargebacks
You are responsible for refunds you issue and for chargebacks your customers initiate. When a customer disputes a payment, we will notify you and deduct the disputed amount from your balance while the dispute is reviewed. You can submit evidence through the dashboard. If the dispute is decided in your favour, the funds are returned to your balance.
If your balance is insufficient to cover refunds, chargebacks or fees, you agree to pay the amount owed, and we may debit your linked bank account.
Acceptable use
You may not use the Services for any illegal activity, or for any business or product listed in our acceptable use policy, including but not limited to: illegal drugs, weapons, counterfeit goods, unlicensed gambling, pyramid schemes, and goods or services that infringe intellectual property. You must describe your products honestly and fulfil orders as promised.
We may suspend or close accounts that breach these rules. Anyone can report abuse of HansaPay.
Card network and wallet rules
Your use of card and wallet payments is subject to the rules of the card networks and wallet providers, which may be updated from time to time. You agree to comply with those rules, including rules on displaying payment marks and on the types of transactions you may process.
Data protection and security
Each party will comply with applicable data protection laws. Our privacy policy explains how we handle personal information. Where we process personal information on your behalf, our data processing addendum applies and forms part of these Terms.
You must not store full card numbers or security codes outside HansaPay. If you handle card data directly, you must maintain your own PCI DSS compliance.
Intellectual property
We own the Services and all related intellectual property. We grant you a limited, non-exclusive, non-transferable licence to use the Services in line with these Terms. You grant us a licence to use your name and logo to provide the Services, such as on hosted checkout pages.
Suspension and termination
You may close your account at any time. We may suspend or terminate your access to the Services if you breach these Terms, if required by law or our partners, or if your account presents an unacceptable risk.
Disclaimers
The Services are provided "as is" and "as available". To the extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Services will be uninterrupted or error-free.
Limitation of liability
To the extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or revenue. Our total liability under these Terms in any 12-month period is limited to the fees you paid us in that period. Nothing in these Terms limits liability that cannot be limited by law.
Indemnity
You agree to indemnify HansaPay against claims, losses and fines arising from your breach of these Terms, your products or services, or your violation of law or network rules.
Changes to these terms
We may update these Terms. For material changes, we will give you at least 30 days' notice by email or in the dashboard. Continuing to use the Services after changes take effect means you accept the updated Terms.
